TP:
24. Notice
(iv) A Member desiring to bring any business before a general meeting may give notice in
writing of that business to the Secretary who shall include that business in the next notice
calling a general meeting given after receipt of the notice from the Member.
(the above bolded and underline text is done by me - Ian)
33. Alteration of objectives and rules.
No alterations may be made to this Constitution except by special resolution,
(i) passed at a general meeting of the association, being a meeting of which at least 21 days
notice, accompanied by notice of intention to propose the resolution as a special resolution,
has been given to members of the association; and
(ii) it is passed by at least ¾ of the votes
-
TP, I will try and find it but as an example the calling of the vote in the change of board members of a couple of years ago (removal of a Qld rep and the appointment of a 3rd Vic rep) was forced by 2 people, one of them being the consultative person on the initial constitution.
-
As the constitution stands now Frank, you would do that first i.e. ask your rep. If your rep doesn't submit your request or the board rejects your request, you then have the option of sending a letter to the Secretary requesting that your request to change the Constitution be submitted to members for a vote at the next General Meeting which at the latest would be the next AGM.
At the moment just 1 single member can ask for their changes be submitted to a membership vote and the Secretary must oblige...the board can NOT stop it going to a membership vote in that scenario.
One way that the proposed changes that you are voting for at this upcoming AGM is so important is that if the issue is important enough, a "Special General Meeting" can be invoked at any time with 100 members agreeing to it instead of potentially waiting for over 1 year for an important change to be voted on.
One thing I personally disagree on is that the number of members required to enforce a membership vote on a Constitutional change is only just 1 member...I think that should be changed to say 20 members and not just a single member.
I further believe that all you members should perhaps get together with those that are driving the Constitutional change and say "Hey, I think "x" is unfair or not right...what can I do to help you guys"...this helps to bring about the "doing" part of what we talk about here.

Recently a US court found in favour of Apple that Samsung stole their technology yet in Japan, the court found that they didn't.
A US court supported Apple, a US company
A Japanese court (independent of both companies) supported Samsung
I am hearing the same type of stories in many other instances in different industries that the US courts have in almost all similar situations, have found for the US company and not for a company from a different country.
Is the legal system in the US stuffed or what?
-------------------------------------------------------
APPLE has filed a fresh patent infringement action in the US against Samsung, alleging that the South Korean company is continuing to use its technology despite a recent court ruling.
The new claim was filed in San Jose, California, on Friday and it says that Samsung, which last month was fined $US1.05 billion ($A1.02 billion) by an American court for "willfully" infringing Apple's patents, is still using its rival's technology.
"Despite that lawsuit, Samsung has continued to flood the market with copycat products," Apple said, adding four of Samsung's most recent releases - including the flagship Galaxy S III smartphone - to an earlier complaint filed in February.
"Apple will suffer and is suffering irreparable harm" because of the alleged infringement, said the maker of the iPhone and iPad.
The new US claim is the latest chapter in a long-running global patent war between the smartphone giants, which have accused each other of stealing intellectual property for their own products.
On August 24, a California jury found the South Korean electronics giant infringed dozens of patents held by Apple.
However, a Japanese court on Friday rejected the US tech giant's claim that Samsung stole its technology.
Apple had sought damages and sought to block sales of some Samsung products in Japan, where both firms have seen their popularity rise in a market traditionally dominated by domestic powerhouses such as Sharp and Sony.
But the claim was rejected and Tokyo District Court's three-judge panel awarded legal costs to Samsung.

Solicitor is handling it all now so I have to be guided but one thing I personally can't understand is why a copy of the letter has not been passed on to all the board and why not one of the board members doesn't put a motion forward to resolve it now...I wonder if they are being told everything?...are any of you being told anything from your board reps?
-
I know Gibbo, and that is just one of the avenues being pursued...there are 2 Acts that RAAus are breaking the law on and my solicitor has advised them of that however there has still been no communication back from them which is sinking them deeper and deeper. This is so extremely unfortunate that along with hefty fines that can, and looks like most likely will, be applied to RAAus, there are also the full costs and damages that they will be required to pay out.
The thing that I personally believe will be the worst thing that they will cause is that every single thing that has gone on at board level will come out into the public's view...even emails that were sent around by Paul Middleton in August 2007 where he told people that I was telling "Porkies" (his words not mine) when I said this site was setup to help all aviators and not as a commercial entity. I am sorry but it has been going on and on and on for many many years all of which I have fought off on behalf of myself, this site and every single RAAus member but now, from what I believe was started by just a couple of people, they have removed my right to fly a recreational aircraft under the privileges which we are all entitled to handed down by CASA...so who is next?
-
Alan, that is done every year...like all Associations etc, the President, Secretary and Treasurer roles are only for 1 year and the normal first business of the board meeting that follows the AGM, the board members elect a new President, Secretary and Treasurer from the available board members for the next 12 months...it's normal practice.
One practice that is often used by Associations etc is the members elect the Executive rather then the board electing their own
-
DP, that was for the RAAus threatening to indirectly sue you people, RAAus members, for defaming Tizzard but nothing went any further then their threatening letter after I responded to them...again it is noted that the rest of the board had no idea that it was started and were surprised when I sent my reply letter to the entire board. I don't know what they did but it could have well been that S&G advised them that they had no chance so that is why it didn't go any further after my reply letter.
Note that this type of thing has been going on for years...a letter from Tizzard demanding to know who a particular site member was and again I replied with a letter saying that I wouldn't disclose such information unless I was ordered to by a court of law...Tizzard's reply was that he was then going to send my refusal to CASA

achieve 8/8's on a good day with a lot of practice but then that would mean he would have to...

There is a 15 pixel padding on the left and right of each main menu item...this is ok "IF" you are not viewing the site using 1024x768 resolution whilst at the same time using a long username...put the two together and I could see the problem...I removed 1 pixel from the left and right padding of menu items which freed up more real estate on the right of the main menu for long usernames when using a small screen resolution.
If there is anyone else still having an issue like this please let me know

Is that better?Good afternoon Ian,I've got a "search" bar thingy covering the alerts and such at the top, on the right hand side. Is there some way I can move it about an inch upwards so it's out of the way please? -
This website will always continue so you will always be able to have your say no matter what, steps were taken some time ago to ensure that it does, so you all still keep on winning with this site being made available for you.

This is still continuing to be fantastic in helping out the site...My task list so far, and is growing, is:
- Review the way the Photo Gallery is used...investigate other possible products and/or enhancements to the current one (post 2)
- Explore ways to entice visitors to register and join in (post 6, 8, 15, 37, 38)
- Fix Site Donation Link (post 17) - FIXED
- Explore what members want in terms of the locking down of Social Groups (post 18)
- Enhance the Search function to allow words of less than 4 characters (post 19)
- Enhance the Mobile Style (post 23)
- Place reminder note next to submit button "Have you checked your post and are familiar with posting rules" (post 25)
- Promote the shop more...home page and site header (post 27-29)
- Explore other means of promoting the site (post 30)
- Fix the Chat Room and now use Aust hosting for faster video/voice (post 31)
- Improved method for spell checking (post 35)
- 95-10 aircraft only section (post 41)
- Feature News Story needs greater variety rather then "Lessons to Learn" (post 42)
- Review navigation structure and see if it can be simplified or made easier (post 43)
- Invite interested parties into the site (post 43)
- Serious thread answers get lost...perhaps an aviation FAQ section, may not be practical and add to confusion (post 44)
- Get RAAus participation...not likely as this has been tried many times over 8 years but tomorrow is another day (post 46)
- Tongue in cheek smilies (post 48) - FIXED
Over the last week I have been revisiting the vBulletin solution...although just playing around at the moment, it has solutions for just about all of the above plus more...if you want to have a look at an old version that I played with you can see it at http://www.aircraftpilots.net/ although a more advanced version is currently on my PC for experimenting. I hope this explains why I haven't just jumped in and worked on the above list yet.
These ideas are great so please keep them coming
- Review the way the Photo Gallery is used...investigate other possible products and/or enhancements to the current one (post 2)

Ok, the two smilies have now been added to the site:

I would just like to say that I find your posts disreputable and would like to add, in an attempt to squash this disreputable behaviour, that my darling wife is a fully trained and certified Beauty Therapist...so there!

Andy...the post says "face to face contact"Also to suggest that Steve or others arent available to discuss this until Natfly next year is plain wrong. I rang Steve today to discuss issues in general and Steve took my call immediately. I dont believe that he has "Andy Saywell" in his list of contacts so pressume that his approach to my call will be no different to teh approach he will take if you can be bothered to ring and discuss issues rationally with his as well.Natural Justice goes both ways and all parties deserve it equally!Andy
-
Steve Runciman has also said in his notice that he will not be attending NORRA-Aus as well so that means no face to face contact that I know of for the general membership till NatFly next year
-
80knts, the results are very interesting aren't they!
How are we, as a species, ever going to get to the "Jetsons" age? Is it going to end up all rotary type aircraft with no runways, just pads?
