  1. It's looks to me that the CASA RPL is nothing more than a thinly disguised PPL restricted by another name. A leopard doesn't easily change its spots. Does however highlight the freedoms that we have in RAA without the real BS.Does however support the requirement that a government department can't support a monopoly.

    It's a GA rating for GA pilots and makes perfect sense in that arena, allowing older GA pilots to keep flying.

    It's RA people who have produced all the conspiracy stories, and tried to do the equivalent of gutting a rabbit from the outside.

So, I'm 15 hours into RPL and loving it - all seems to be coming together but about every 1 in 6 landings my instructor chips me for pushing the control column forward after the main wheels touch - I know not to do it and I'm actually not conscious of doing it - any tips/tricks/advice on how to refine this?

    Human Factors - any "memory" message, like saying out loud "touch.....and hold"

  5. Yes, it is easy to spend several hundred thousand and then lose your house if you go down a dead end path.

     

    The reason I've argued so much about the numbers being irrelevant to the Jab instrument is to try to dissuade people from losing their money going down that path.

  6. A lot of people repeat this myth of CASA having deep pockets, but the law is the law and you can certainly win a case. On the other hand some of the guilty will never admit they are guilty and will use any excuse to rationalise what happened to them.

    We are not at odds about that, just the terminology. The members elect representatives to manage the employees and come up with policy.

     

    I think you'll find this is how the majority of company boards operate.

    They do, but Recreational Aviation Australia is not a company, and is not a corporation as it refers to itself on the website, it is an Incorporated Association

    The board members are members of a board or management; they are not directors.

     

    If you want a taste of how a company, with board of directors would run RAA, it has been leaning that way recently, and that has led recently to people expressing concerns about decisions and costs.

     

    As you say, there is nothing wrong with the members changing the Constitution to whatever they want, but it would help if they could see proposed changes before they happened.

  10. That is still my preference, and I've copped flak for being a wimp in gusty conditions.

    Just make a list of their names, and wait; before long one will go quiet and won't be seen around the airfield for a while, you'll get a report back from another airfield where one came unstuck spectacularly, there'll be undercarriage/wingtip damage to one of the aircraft in the hangar, and one will admit that he screwed up, but not necessarily that you were right.

  11. I think you are trying to create interpretations which simply aren't there. CASA do not require a position titled "Accountable Manager", they require the position be it the CEO, the President or the Ops Manager to be the nominated Accountable Manager.

    That's correct, they do not, but they do spell out their requirement for the board members key responsibilities.

     

    I've not seen anywhere in the "handbook" that it requires Board members be involved in the day to day operations of the association. They need to be across the oversight of the association insuring the association (not the board nor the CEO) meets it's requirements.

    That's correct, CASA don't require this, but the Constitution requires a board of management (not a board of directors just doing oversight) A board of management has to actively manage.

     

    The Deed of Agreement (the actual legal binding document) has the terms Specified Person and Organisation's Representative and actually has the names of the people nominated for those positions (2014 was General Manager Mark Clayton and President Rodney Birrell). The Deed in clause 13 actually says it's the Specified Persons who is responsible for ensuring compliance with the Deeds tasks and funcations.

    There is a deed of agreement each year which the parties sign; that's why specific people sign. I've never found a base document where all the year by year accumulated agreements carry forward; each year is a hand wash of the year before. Think of it as a "What will we agree to do this year" document, because that's all it can be the way it has been handled. Personally I don't see it as having any real significance - the agreements could just as easily be made between CASA and RAA ad hoc.

     

     

  12. The board should only be there for policy and oversight, the office should be handling the day to day.

    The Constitution doesn't say that, it refers to a board of management and I've previously posted the board manager duties required by CASA in 2010. Ultimately that could bite the board members who ignore it.

     

     

  13. Don't know about campaign, but the action CASA took was not in everyone's best interest. I think there was a better way and this has damaged Jabiru, flying schools, operators and owners and the values of Jabirus.Doing it on the last day of the CFI conference after being present and saying nothing, then getting so much feed back and ignoring it and putting limitation on just before Christmas, then extending for a year and also the data is not good. They attacked other manufacturers before and now it has to be fixed !

    There's no doubt the fallout has been very painful for a lot of people.

    Re the CFI conference, that's not unusual for large organizations; I've experienced it many times through the years. It can be because the people who made the decision didn't tell the people who attended the conference, or the people who made the decision told the people who attended the conference that no one was to say anything until the decision had been centrally released/recipient advised etc. Every time this happens in large organizations they look like clutzes - a very foolish way of handling things.

     

    Re before Christmas - someone could have gone down Christmas Day; I've been in situations where I've had to push for a vote for safety action, in one case affecting 1100 young and enthusiastic competitors, and you're never going to be popular, but once you become aware of a perceived risk, legally you have to act there and then.

     

    Re the data; why don't you talk to CASA and find out who gave it to them and why?

  14. As far as I read the law (as a non lawyer) CASA can't be sued, there is no ombudsman, they can't be taken to the Administrative Appeals tribunal. They seem top be a law unto themselves. They have absolute power and we know what absolute power does . . . corrupts absolutely some might say.

    I've recommended several times that posters refer to the Civil Aviation Act 1988, and other Acts relating to CASA rather than continuing to post crap.

     

    CASA can sue and can be sued - see Part II section 8 ©

     

    Part II—Establishment, functions etc. of CASA

     

     

     

    8 Establishment of CASA

     

    (1) An authority called the Civil Aviation Safety Authority is established by this subsection.

     

    (2) CASA:

     

    (a) is a body corporate with perpetual succession;

     

    (b) shall have a seal; and

     

    © may sue and be sued in its corporate name.

     

     

    Not only that, but Natural Justice is built into the system through access to an Administrative Appeals Tribunal.

     

     

     

    In the case of Camel's campaign, I drew attention to the involvement of DIRD in Instrument 292/14

     

     

     

    I also suggested people check the powers available to CASA regarding that particular instrument.

     

     

     

    Checking as I recommended would have showed up the process CASA followed, that there was no requirement for any numbers (so the endless fight over mythical numbers was a distraction), and that there was an opportunity for Natural Justice through AAT, apparently not taken up.
